Fabric Heaquarters TERMS OF SERVICE ("AGREEMENT")

Please read these Terms of Service ("Agreement", "Terms of Service") carefully before using http://fabric-hq.com ("the Site") operated by TIMIROM, Inc ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://fabric-hq.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.
The Site and its original content, features and functionality are owned by TIMIROM, Inc and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Florida, USA, without giving effect to any principles of conflicts of law.
Any damage to shipped items must be reported in 5 business days. Customers must retain any and all packaging the items arrived in (shippers' requirements for claims filed). Customers who wish to file damage claims after 5 business days must do so themselves through the appropriate shipping company. Any customers not adhering to the above terms, their orders will be considered acceptable and free of damage/defect.
We strive to get our fabrics out to you as soon as possible, Most of the time we can meet our 3-5 business day shipping time. Occasionally you may order more fabric than is available, or due to a seam in the bolt. In which case we will contact you with your options.
Refunds are only awarded after authorization to send product back has been given. If you need to return a product, contact us on first. Customers must contact us with in 3 business days of receiving the order. Returns MUST be received within 5 days one a RMA has been created. An unauthorized return will result in funds and items being forfeited.
All products must be returned in the original packaging (unless new packaging ok'd prior), new, unused, uncut/damaged, and free of all odors, stains, damage, and pet hair. Any returns not complying to the above terms will be denied. Customer will get the refund for the purchase price of the product only. All original shipping costs are the customers' responsibility - even though we offer free shipping, there is still a cost, and this cost will be deducted from your return.. A 25% restocking fee will be applied. Packages refused at time of delivery will not be refunded under any circumstance. These packages can take 6 weeks or more to be returned to us. Any items undeliverable as addressed/incomplete address or similar will be re-shipped at the buyers' expense. Charge-backs filed against our company may result in a police report being filed for any missing items as well as further legal action. Customer is responsible for the original purchase price, retail shipping price,as well as any bank and/or legal fees associated with disputing the charge-back. Returns and exchange details
An unauthorized return will result in funds and items being forfeited. This includes items that are refused at time of delivery or items sent by via return to sender (or similar)
All products must be returned in the original packaging (unless new packaging ok'd prior), new, unused, uncut/damaged, and free of all odors, stains, damage, and pet hair. Any returns not complying to the above terms will be denied. Customer will get the refund for the purchase price of the product only. All retail shipping costs are the customers' responsibility. A 25% restocking fee will be applied. Packages refused at time of delivery will not be refunded under any circumstance. These packages can take 6 weeks or more to be returned to us.
Our policy states that we do not accept cancellations. This is due to the fat we have a high number of listings that are "ships same day items". Once these are placed there are no cancellations - no exceptions.
NON - "SHIPS SAME DAY ITEMS"
If an exception is granted it must meet the following terms
Custom Listings, pillow covers/cases/curtain panels and special orders are unable to be cancelled after 24hrs, orders cancelled prior are subject to a 25% restock fee.
No refunds on orders already shipped. We reserve the right to refuse any refund.
All cancellations/returns are subject to a 25% restocking fee. Original shipping fees are non-refundable. All domestic returns must be received in 4 business days from authorization with a copy of original order for credit. Authorizations for returns must be requested within 3 business days of original delivery date. Items returned without prior authorization will not be accepted and no refund issued. International returns must be received in 14 business days from authorization.
No refunds on custom orders/custom listings or pillow covers.
SPECIAL ORDER / SHIP FROM MFG ITEMS
All special order, ship direct from mfg, half bolts, or full bolts are final sale. As these ship direct from them manufacturer, and the mfg is responsible for inspecting the goods - any and all defects contained in the fabric are considered acceptable for first quality goods and will not be covered. Bolts may come with a seam or in multiple pieces form the same dye lot. this is beyond our control and not covered by any return/exchange policy. These items are all FINAL SALE with no return/exchange for any reason. Any damage must be taken up with the shipping company. Buyer assumes all risks.
In the event we send you the wrong product, we will cover all charges associated with getting you the correct product.
No returns/exchanges on Clearance section items. Cancellation notices must be received within 24 hours on all items.
Any incomplete or incorrect orders must contact us with in 3 business days or receiving the order or no credit will be given.
As most of our items are "Ships Same Day", we cannot cancel any orders once they are placed.
Fabric is cut off the roll as it falls, meaning no section or complete print is guaranteed to be featured in any given cut
No credits will be issued of an unauthorized return. Unauthorized returns /refused packages/ unpaid customs fees will be considered abandoned items, and customer forfeits any store credit or refund.
Our shop stocks only 1st quality prints. We order direct from the designers to insure the highest quality possible unlike other vendors who deal directly with the Mill to get 2nds and 3rds and can sell them at a cheaper price.
Premier Prints fabrics are 1st quality from Premier Prints, they are however a much cheaper fabric than the other brands we stock. This means the fabric may have inclusions such as (but not limited to): seams in the fabric, printing off register, crooked prints, slub lines, etc. These have passed Premier Prints quality inspections, and as such, they have deemed this normal stock. We will not replace/refund Premier Prints due to these defects as getting a bolt of fabric from them always includes these defects. For Premier Prints quality issues, we recommend you contact Premier Prints directly. Bolts (30 or 60) may have seams in them. This is beyond our control.
Once an item has been cut or altered we will not honor any warranty up to and including incorrect amount of fabric being sent. All fabrics must be checked for errors and we must be notified with in 3 days of delivery for any fabric issues. Items sent to a third party are considered correct upon delivery and no warranty is offered.
REFUSED DELIVERY/REFUSAL TO PAY DUTY TAXES/FEES
Any refusal of of any package for duties, taxes, and/or fees will be considered delivered and no refund issued under any circumstance.
Items attempted delivery and any refusal to pick up item from carrier will be considered delivered and no refund issued under any circumstance.
Items refused or sent back without authorization will be considered delivered and no refund issued under any circumstance. Customer is responsible for shipping items back to them at their own expense. Any items that are not delivered due to customer entry error, no mail service at address, undeliverable as addressed, or refused will result in the customer covering all shipping charges including any (retail) costs to re-ship the items. Items not re-shipped with in 30 days will be considered abandoned and the customer will forfeit any claim to fabric/funds. Refusal to re-ship items will result in a forfeiture.
Special Order Items
All special order items carry a "Minimum Quantity" that must be ordered. Any previous purchases do not count towards this minimum quantity.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
